J.Guillem fully complies with the General Date Protection Regulation (GDPR), which came into effect on 25 May 2018. We are committed to protecting your personal data and respecting your privacy. This Privacy Policy sets out how we do this when you visit our site, informs you of your rights and explains how you are protected when on our site, within the terms of the GDPR directive.


What this Privacy Policy is for

You should read this policy to understand what data we collect when you visit our website and how we process and store it. And how we interpret what is personal and non-personal data, why and where we use it.

This website has been designed for adults, aged at least 18 (the age at which you can apply for a credit card) and is not intended for persons under that age. Nor do we seek to or knowingly collect data from or relating to persons under the age of 18.

In line with GDPR, you have the legal right to contact us at any time to request what data we hold on you, how it is stored, processed and used, as well as to correct or delete it. Full details of how you can do that is provided below.

It is important to us that the personal data we hold about you is correct and up to date. So please get in touch if your personal data changes at any time - like when you move home.

From time to time, this website may include links to third parties’ websites, plug-ins and applications. If you select these and leave our site, we are no longer in control of your personal data. Neither are we responsible for the way these third parties collect and use data, nor their privacy statements. You should always read the privacy policy of any site you visit.


Your data

We collect both personal and ‘anonymous’ data. Personal data is defined as information about an individual that can be used to identify them. Data where your identity (e.g. name, address, date of birth) has been removed is classed as anonymous data. We collect, store, use and sometimes transfer, personal data in different ways. And classify it for different purposes which we have set out below to help you understand.

  • Contact Data - addresses (billing, shipping, email) and your phone numbers
  • Financial Data – bank and card details
  • Transaction Data – any data relating to products and services you have bought/returned from/to us

  • Marketing Data – your preferred way of communication with us, and what you are happy or unhappy to receive or be contacted about.

J.Guillem may also collect, use and share Aggregated Data, which may be derived from your personal data but does not directly or indirectly reveal your identity so is not classified as personal data. Examples of this type of data include demographics wherein we may combine your usage data with that of other users to understand how our site is performing. Rest assured, whenever aggregated data is combined with your personal data so you could be identified directly or indirectly, we would regard that usage as being personal data and therefore protected and governed by the terms of this privacy policy.

We do not collect sensitive Personal Data like your ethnicity, criminal record, armed forces history, sexual orientation, political opinions, trade union membership, religious beliefs, health, genetic or biometric data.

If we need your personal data so that we can act in accordance with contract law in the provision of goods or services to you, and you fail to provide us with the necessary details, we will have to cancel any mooted transaction. We would seek your permission to have this data before we did that.


Collecting your data

We collect data about you in a number of direct and indirect ways:

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.

We implement a variety of security measures when a user places an order enters, submits, or accesses their information to maintain the safety of your personal information.

All transactions are processed through a gateway provider and are not stored or processed on our servers.

  • Registering you as a new customer so that you can purchase from us and we can process, manage all associated costs and deliver your order.

Opting in and out of marketing and promotional activity

We will send you communications (via your stated preferred contact method) about products and services that we believe are relevant to you - based on the personal, technical, transactional and behavioural data we hold on record. We will only do this if we have your consent, given when you purchased from us, subscribed to our communications, entered a competition or prize draw, or completed a review or survey, and in each case did not choose to opt out of these types of communications. We will never give your personal data to, or let it be used by, third parties for marketing purposes without your expressed content by way of additional opt-in.

You can opt out of all these types of messages, from J.Guillem and third parties with whom we may collaborate, at any time. Simply log into our site and amend your ‘Marketing preferences’ within your account details. We promise that all marketing messages will also give you the option to opt out of future communications via an unsubscribe link.

Please note, opting out of marketing communications does not mean the personal data we hold for you from a product/service purchase, warranty registration, product/service experience or other transactions will be deleted. Although you can of course alter, amend, request to see or delete that data at any time – please see the contact details at the bottom of this policy.

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we need to use it for another reason that we believe is reasonably compatible with the original purpose. We will notify you if we need to use your personal data for an unrelated purpose and explain the legal basis we believe give us the requisite permission.


Third Party disclosure and international transfer of your Personal Data

As some of our partner suppliers (e.g. our email provider) are based outside the European Union and European Economic Area, when we utilise their services we do, in effect, transfer your personal data. However, we ensure your data is protected either by:

  • Only transferring it to countries that the European Commission (EC) deem to provide an adequate level of personal data protection.
  • Or we stipulate and use specific contracts designed to protect data that have been approved by the EC.
  • Or if the third part is a US based company they must be part of the EU-US Privacy Shield which provides the same levels of protection as EC safeguards as proscribed in this privacy policy.

We may also have to share your personal data if we were to change the ownership structure of J.Guillem or invest in other entities. In this event, the new ownership would be able to continue using your personal data in line with this policy. In any event, we require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.


Keeping your personal data safe

We have designed our site to protect the information we collect online from unauthorised access. We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. We safeguard your private information by implementing the appropriate physical, electronic and managerial procedures necessary to protect your privacy. Furthermore, we strictly limit access to your personal data to those employees, agents, contractors and other third parties who have a ‘critical business need to use’ it. We have procedures in place to counter, cope and manage any suspected breach in our security systems, which include notifying you and, where appropriate and if required, any regulator of such an occurrence.We will only keep your data for as long as it we need to be able use if for the purposes it was first collected, including any regulatory, mandatory or reporting requirements. We are required to keep certain Contact, Identity, Financial and Transaction Data about our customers for up seven six years since their last transaction with us for different EU country tax purposes.


Your rights under GDPR
